By registering for and participating in programs offered by The Netball Co., you (the participant and/or parent/guardian) agree to be bound by these Terms and Conditions.

## 1. DEFINITIONS
**"The Netball Co."** refers to the business, its directors, employees, coaches, volunteers, and authorized representatives.
**"Participant"** refers to the individual enrolled in The Netball Co. programs.
**"Parent/Guardian"** refers to the legal parent or guardian of a participant under 18 years of age.
**"Programs"** refers to all netball coaching services, clinics, camps, and related activities offered by The Netball Co.

## 2. REGISTRATION AND PAYMENT
**2.1 Registration Process**
- Registration is only complete upon receipt of full payment and completed registration forms
- All information provided must be accurate and complete
- Participants under 18 require parent/guardian consent and signature
**2.2 Payment Terms**
- Payment is due in full at time of registration unless alternative arrangements are made
- Early bird discounts apply only to bookings paid by the specified deadline
**2.3 Booking Confirmation**
- Email confirmation will be sent within 24 hours of payment receipt
- Failure to receive confirmation does not guarantee a booking - contact us immediately if confirmation is not received

## 3. CANCELLATIONS AND REFUNDS
**3.1 Cancellation by Participant**
- More than 48 Hours before program start: Full refund minus $15 administration fee
- Less Than 48 Hours before program start: 50% refund
- Less than 24 Hours before program start: No refund
- Medical exemptions with appropriate documentation may be considered
**3.2 Cancellation by The Netball Co.**
- Full refunds provided if programs are cancelled due to insufficient numbers, weather, or unforeseen circumstances
- Alternative dates or venues will be offered where possible
**3.3 Transfer Policy**
- Bookings may be transferred between participants or programs subject to availability
- Transfer requests must be made at least 48 hours before the original program date

## 4. PARTICIPANT REQUIREMENTS AND CONDUCT
**4.1 Health and Fitness**
- Participants must be physically and mentally capable of participation
- All medical conditions, allergies, and medications must be disclosed
- Participants participate at their own risk
**4.2 Behavior Expectations**
- Participants must follow all reasonable instructions from coaches and staff
- Respectful behavior toward coaches, staff, and other participants is required
- Inappropriate behavior may result in immediate removal without refund
**4.3 Equipment and Attire**
- Participants must wear appropriate sporting attire and footwear
- The Netball Co. is not responsible for lost, stolen, or damaged personal items

## 5. RISK ACKNOWLEDGMENT AND LIABILITY
**5.1 Inherent Risks**
By participating, you acknowledge that netball involves inherent risks including but not limited to:
- Physical contact with other players
- Risk of falls, collisions, and equipment-related injuries
- Muscle strains, sprains, cuts, and bruises
- Risk of serious injury or death (though rare)
**5.2 Assumption of Risk**
- Participation is voluntary and at the participant's own risk
- You understand these risks cannot be eliminated regardless of safety measures taken
**5.3 Release and Limitation of Liability**
To the fullest extent permitted by law:
- You release The Netball Co. from liability for any injury, loss, or damage arising from participation
- This includes liability for The Netball Co.'s own negligence, except where prohibited by law
- Our total liability is limited to the amount paid for the program
**5.4 Indemnity**
You agree to indemnify The Netball Co. against any claims arising from the participant's actions or participation in programs.

## 6. MEDICAL TREATMENT AND EMERGENCY PROCEDURES
**6.1 Medical Information**
- Accurate medical information must be provided during registration
- Updates to medical conditions must be communicated immediately
**6.2 Emergency Treatment**
- You authorize The Netball Co. to seek emergency medical treatment if required
- You are responsible for any medical costs incurred
- Staff will attempt to contact emergency contacts but may act without consent in emergencies
**6.3 Insurance**
- The Netball Co. maintains public liability insurance
- Participants are encouraged to maintain personal accident and health insurance
- The Netball Co.'s insurance does not cover personal injuries to participants

## 7. SUPERVISION AND COLLECTION
**7.1 Supervision Period**
- Supervision is provided only during scheduled program times
- Participants must be collected promptly at program conclusion
- Late collection fees may apply
**7.2 Authorized Collection**
- Only authorized individuals may collect participants
- Photo identification may be required
- Children 12+ may be authorized to leave independently with written consent

## 8. PRIVACY AND MEDIA
**8.1 Privacy**
- Personal information is collected for program administration and safety purposes
- Information is handled in accordance with Australian Privacy Principles
- Information will not be disclosed to third parties except as required by law
**8.2 Photography and Media Consent**
By registering for The Netball Co. programs, you automatically grant permission for The Netball Co. to:
- Take photographs, videos, and audio recordings of participants during programs
- Use these images and recordings for promotional, marketing, educational, and social media purposes
- Publish these materials on our website, social media platforms, marketing materials, and other promotional content
- Share these materials with media outlets for promotional purposes
**8.3 Opt-Out Process**
- If you do NOT wish your child to be photographed or recorded, you must explicitly notify The Netball Co. in writing during registration
- Opt-out requests must be clearly marked on registration forms or communicated via email
- Parents who opt out acknowledge that their child may appear in background shots of group activities
**8.4 Media Usage Rights**
- The Netball Co. retains perpetual, royalty-free rights to use approved photographs and recordings
- No compensation will be provided for use of participant images
- Images may be edited, cropped, or modified for promotional purposes
- The Netball Co. may license images to third parties for promotional use related to netball or youth sports

## 9. INTELLECTUAL PROPERTY
All coaching methods, training materials, and program content remain the intellectual property of The Netball Co. and may not be reproduced or used without written consent.

## 10. FORCE MAJEURE
The Netball Co. is not liable for failure to provide services due to circumstances beyond our control, including but not limited to natural disasters, government restrictions, facility closures, or public health emergencies.

## 11. DISPUTE RESOLUTION
**11.1 Complaints Process**
- Complaints should first be directed to The Netball Co. management
- We will make reasonable efforts to resolve disputes amicably
**11.2 Governing Law**
- These terms are governed by the laws of NSW, Australia
- Disputes will be resolved in the courts of NSW, Australia

## 12. GENERAL PROVISIONS
**12.1 Entire Agreement**
These terms constitute the entire agreement between parties and supersede all prior agreements or representations.
**12.2 Amendments**
The Netball Co. may update these terms at any time. Continued participation constitutes acceptance of amended terms.
**12.3 Severability**
If any provision is found invalid, the remaining provisions remain in full effect.
**12.4 Consumer Rights**
Nothing in these terms excludes, restricts, or modifies rights under Australian Consumer Law that cannot be excluded.
